Across the United States, elementary and secondary schools entering the new academic year lack uniform standards governing the use of artificial intelligence tools in coursework. Teachers and administrators have scrambled to formulate policies on integrating generative AI into instruction, yet many districts remain without clear direction on which systems students may access or how the technology should function in learning environments.

The explosive growth of AI for text and image generation, combined with student eagerness to complete assignments efficiently, has prompted most school districts to adopt a measured stance. Many have established basic safeguards and incorporated AI education into curricula while avoiding detailed, district-wide mandates about specific tools. Instead, they have delegated classroom decisions to individual instructors and largely ignored student use outside school buildings. Some districts have not issued any formal guidance whatsoever.

The absence of explicit rules has created significant uncertainty for educators. In a 2025 survey, 60 percent of teachers reported that their districts' policies lacked clarity. A Gallup poll conducted earlier this year found that just 18 percent of teachers had received formal guidance from school leadership on deploying AI tools in instruction.

Student awareness of AI's capabilities and limitations remains limited despite widespread adoption. According to a recent Common Sense Media survey, seven in 10 teenagers use AI for schoolwork, yet fewer than one-third have discussed the technology's fundamentals with a teacher. Only 44 percent reported receiving instruction on appropriate and inappropriate uses for coursework.

A focus on AI literacy

Chicago Public Schools, the nation's third-largest district, unveiled a generative AI guidebook in 2024 emphasizing principles such as transparency and accessibility. The document, revised multiple times since publication, prioritizes understanding how AI functions and has embedded AI literacy throughout its K-12 offerings.

The district encourages students to treat approved AI applications as a "co-pilot" and to verify all outputs. CPS maintains a curated list of approved educational technologies featuring AI-powered options but excludes widely used platforms such as ChatGPT and Claude. The guidebook does reference age restrictions established by those vendors alongside Gemini and Perplexity.

Some have criticized Chicago's policies as insufficiently restrictive. Illinois Families for Public Schools, a parent advocacy group, has secured pledges from half of the candidates running for the Chicago School Board this fall to strengthen AI restrictions if elected. Their proposed commitments include a three-year moratorium on generative AI deployment, limitations on screen time, and establishment of a chief privacy officer position.

Houston Independent School District, the nation's ninth-largest system, also released an AI guidebook in 2024. The document outlines principles centered on learning outcomes and academic honesty, specifying that students under 14 may study generative AI and use pre-approved tools during supervised classroom work, while older students require parental consent and teacher permission to access approved systems.

Houston ISD's guidance emphasizes that students should "understand what Generative AI is and is not, its opportunities and limitations, and ways to apply the tools judiciously to augment their own knowledge, creativity, and problem-solving abilities in their studies." The district has partnered with OpenAI to provide ChatGPT Edu, an education-focused version of the platform. Additionally, nine campuses operate as "Future 2" schools with specialized programming designed to prepare students for an "AI-enabled world," with up to 100 schools expected to adopt this model by July 2031.

Both Chicago and Houston worked with AI for Education, a New York-based organization, while developing their frameworks. The company has assisted over 40 districts nationwide in creating generative AI guidelines. CEO Amanda Bickerstaff explained the organization's philosophy to Continental Brief: "Every day, it just becomes clearer to me that AI literacy cannot be done well without guardrails, and guardrails cannot be done well without AI literacy. Literacy must go hand in hand because the technology is too new. It works too differently than how you think it does, and it is too disruptive to be able to just come out with one or the other."

Charleston County Schools in South Carolina, which serves nearly 50,000 students, developed its AI policy over two years using what it calls a S.E.E. framework. Students are prompted to evaluate tools by asking: Is it safe? Is it ethical? Is it effective? This approach has guided practical decisions about which technologies to permit and who may access them.

Deputy Superintendent Luke Clamp stated that guidelines "empower the school system to then act towards a common goal, which for us is to integrate generative AI into the system appropriately." Entering this academic year, Charleston teachers will have access to MagicSchool, an AI tool for lesson planning and activity design, with potential student access planned for the future. Clamp emphasized: "We don't see this tool, [or] any other tool, to be a replacement for an in-person instructor in the classroom."

Charleston has prioritized AI literacy development for educators, which will subsequently reach students. Teachers participated in professional development sessions organized by AI for Education over the summer, while others took an AI course at Clemson University. The district launched a website resource hub offering information for teachers, students, and families.

The district's commitment stems from conviction that AI will reshape education and employment. Clamp noted: "We did not want to be behind the eight ball, if you will, on how we integrate with it."

Confusion dominates

Los Angeles Unified School District, serving over half a million students, released AI guidelines in April 2024 requiring district screening of tools for data privacy and parental consent for specific applications. The district also launched a proprietary chatbot called "Ed" but discontinued it after three months. In February, Superintendent Alberto Carvalho's residence was raided by the FBI, reportedly connected to his involvement with the company behind the $3 million chatbot project.

LAUSD appears to have modified its AI policies since the 2024 guidelines. According to a Los Angeles Times report from September 2025, students under 13 faced classroom restrictions on the technology, while older students were required to sign a responsible use agreement, though these rules lack public visibility on the district's website. In June 2026, LAUSD banned screen time before second grade and instituted age-based restrictions to be phased in during this year and next. While not exclusively targeting AI, this policy will constrain its deployment and includes a review of classroom technology contracts.

Miami-Dade County Public Schools, the nation's third-largest district, presents an even murkier picture. The school board approved a measure in August 2025 directing the superintendent to create AI guidance featuring a tiered framework for classroom tasks, but no such rules have been publicly released. Meanwhile, the district partnered with Google to offer Gemini to high school students and teachers.

Orange County Public Schools, the eighth-largest district with over 200,000 students, released an AI policy this summer permitting student research use while prohibiting submission of AI-generated graded work. The district assigns responsibility for classroom AI guidelines to individual teachers.

School Board Member Maria Salamanca acknowledged the challenge at the meeting where the policy passed: "It's like building a plane while we're flying. It's moving so quickly, and I think that this board, above all else, mostly cares about safety and guardrails."

Could AI bans be coming?

Public sentiment toward AI is shifting negatively, as evidenced by opposition to data center expansion. This sentiment is translating into resistance against bringing generative AI into K-12 education.

The New York City Department of Education released a draft generative AI policy in March employing green, yellow, and red light designations for implementations while largely deferring student use decisions to individual teachers. The proposal faced immediate and substantial opposition: hundreds of parents testified against it, city council members signed a letter stating it was insufficient, and educators organized for a moratorium. The education department announced a pause on new guidance, with updated rules not yet released as students prepare to return.

Momentum for school AI moratoriums is accelerating. FairPlay released a letter signed by over 200 organizations and experts calling for a five-year suspension of AI citing learning and mental health risks. The Brookings Institute published a report concluding that "at this point in its trajectory, the risks of utilizing generative AI in children's education overshadow its benefits."

Some school districts have responded to these calls. The Katy Independent School District near Houston announced in July a ban on generative AI tools for kindergarten through sixth grade. The Haddonfield School District in New Jersey barred their use for kindergarten through second grade earlier this month.

What about other regulators?

Beyond individual districts, other governing bodies are establishing AI rules for education. Thirty-five states have adopted official guidance or policies on classroom AI, though a smaller number actually mandate that schools implement specific policies.

Most state frameworks resemble district-level approaches: use limitations, technology literacy emphasis for students and educators, and recognition of AI's future workplace role. Some state frameworks have proven challenging for districts to implement.

The Center for Democracy and Technology has urged states to assume greater responsibility in integrating AI into education, emphasizing data privacy risks, harmful use prevention, vendor restrictions, and transparency regarding approved classroom technologies.

The federal government has also engaged through the 2025 executive order on "Advancing Artificial Intelligence Education for American Youth," which funds AI literacy training for teachers, establishes a dedicated education task force, and directs the National Science Foundation to prioritize training programs expanding AI instruction. Technology companies including Google, NVIDIA, and xAI have committed to providing youth AI training resources under the executive order.
